1. The Service
103 General Smith LLC ("we," "us," "our") operates Harbor Shuttle, a complimentary, non-commercial golf cart transportation service in Sackets Harbor, New York. Use of this service is a courtesy offered at our discretion and is subject to availability.
2. Acceptance of Terms
By submitting a ride request, you agree to these Terms and Conditions. If you do not agree, please do not use the service.
3. Eligibility and Conduct
By using the service, you agree to:
- Be at least 18 years of age, or be accompanied by a parent or guardian
- Treat the driver and other passengers with respect
- Not bring hazardous materials, open containers of alcohol, or illegal substances
- Comply with the driver's reasonable instructions at all times
- Not exceed the stated party size of 6 passengers
We reserve the right to refuse service to anyone at any time for any reason.
4. No Guarantee of Service
The shuttle operates on a best-effort basis. We do not guarantee wait times, availability, or completion of any ride. The service may be suspended at any time without notice due to weather, maintenance, or other operational factors.
5. Assumption of Risk
Use of the Harbor Shuttle is at your own risk. Golf cart transportation involves inherent risks. By using the service, you acknowledge these risks and voluntarily assume them.
6. Limitation of Liability
To the fullest extent permitted by law, 103 General Smith LLC, its owners, employees, and agents shall not be liable for any injury, loss, damage, or delay arising from your use of the Harbor Shuttle. Our total liability, if any, shall not exceed $100.
7. Indemnification
You agree to indemnify and hold harmless 103 General Smith LLC and its representatives from any claims, damages, or expenses arising from your use of the service or your violation of these Terms.
8. SMS Communications
By providing your phone number, you consent to receive transactional SMS messages related to your ride. You may opt out at any time by replying STOP to any message.
9. Gratuity
The Harbor Shuttle is provided free of charge. Gratuities for the driver are welcomed but never required.
10. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Jefferson County, New York.
11. Changes to These Terms
We may update these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
